1. Participation Terms

1.1 Physical Fitness and Compliance

• You certify that you are physically fit and able to participate.
• You will follow rules, regulations, and norms for all safety concerns.

1.2 Assumption of Risks

• You acknowledge risks including injury, disability, death, and property loss.
• You assume all risks, known and unknown.

1.3 Special Considerations: COVID-19

• You voluntarily assume the risk of exposure.
• Do not participate if unwell; notify your health status.
• Follow all applicable health and safety guidelines.

1.4 Waiver and Release of Liability

• You waive claims against the app affiliates for damages, injuries, losses, and expenses.
• You agree to indemnify and hold NG harmless from related claims.

1.5 Medical Treatment and Consent Release

• You consent to medical treatment during any event and release NG from responsibility.
• You understand that NG may not provide medical care and may charge for promotional purposes.

1.6 Waiver Construction

This waiver is construed broadly to provide a release to the maximum extent permissible by law.

1.7 Acknowledgment of Understanding

You acknowledge that you have read and understand this waiver and sign voluntarily.

2. Code of Conduct

All participants must be civil, ethical, moral and adhere to conduct standards. Violations may result in removal from events or the platform.

3. App Usage & Payment Terms

3.1 Account Registration

Provide accurate information and keep credentials secure. NG is not responsible for unauthorized access.

3.2 Payments, Fees, and Refunds

• Payments are processed securely by third-party processors. NG does not store payment information.
• Event fees are non-refundable except for organizer cancellation, inclement weather, or administrative fees.
• If an event is canceled, credits or refunds may be issued as appropriate.

3.3 Event Cancellation

Platform may terminate or modify an event connecting hosts and players. Events are organized and managed by independent hosts. These are responsible for compliance and are dedicated hosts.

4. Legal Disclaimers

4.1 Limitation of Liability

• NG is not liable for injury, property damage, or death.
• NG does not control event quality or conduct of hosts/players.
• NG is not liable for damages or app malfunctions.

4.3 Governing Law and Dispute Resolution

These terms are governed by the laws of the State of New York. Disputes are resolved by arbitration in New York County unless otherwise waived by law.

4.4 Modification of Terms

NG may modify these Terms at any time. Continued use indicates acceptance.

By participating in any NextGoal event or using the app, you confirm you have read, understood, and agreed to these Terms.
